PHYSICAL INSPECTION OF IMPORTED GOODS

THE REGULATION OF THE DIRECTOR GENERAL OF CUSTOMS AND EXCISE ON PHYSICAL INSPECTION OF IMPORTED GOODS.

Article 1

Referred to in this regulation as:

Article 2

(1) Physical inspection shall be an activity executed by goods inspectors to ascertain the quantity and kinds of the inspected imported-goods for clarifying and stipulating the customs value.

(2) Ex-officio inspection is physical inspection of goods applied by ex-officio customs and excise officials on the risk and costs of importers in a bid to safeguard state rights and meet the provisions of legislation in force.

Article 3

(1) Physical inspection can be applied to imported goods.

(2) Physical inspection in the framework of service is executed by goods inspectors.

(2) Importers or their proxies must be present in the physical inspection.

(3) Ex-officio inspection excludes from the provisions as intended in paragraphs (1) and (2).

Article 6

(1) Physical inspection is executed on the basis of physical inspection levels, namely 10%, 30% and 100%.

(2) The Physical inspection levels are stipulated by:

(2) The implementation of physical inspection is mentioned on the basis of:

(1) The service application system determines number of container, where container must be counted and physical inspection must be executed

(2) Document examiners or heads of the customs and excise section determine number of packages, which must be inspected by goods inspectors in the case of imported goods being packed in numbered packages.

(3) The appointment of numbers of packages as meant in paragraph (1) is based on professional judgement of document examiners or heads of the customs and excise section in the framework of classifying and stipulating the customs value.

(4) The quantity of the numbered packages as intended in paragraph (1) may not exceed the quantity as stipulated in the percentage of the physical inspection levels.

Article 9

(1) Physical ispection of imported goods packed in container with the physical inspection level as high as 10% or 30% is executed as follows:

(2) The service application system determines number or numbers of containers where the package as intended in paragraph (1) must be inspected physically.

(3) Importers are obliged to strip all packages from the appointed containers.

(4) In the case of the packages of the appointed containers as intended in paragraph (1) sub-paragraph a which had yet to be fulfill the percentage or inspection level, goods inspectors determine other containers for inspection.

Article 10

Physical inspection of imported goods packed in non-container package with the physical inspection level as high as 10% or 30% is physical inspection as high as 10% (ten percent) or 30% (thirty percent) of the total declared packages with the minimum quantity 2 (two) packages.

Article 11

Physical inspection of imported goods with the physical inspection level as high as 100% is physical inspection of the whole declared packages.

(1) Physical inspection as high as 10% (ten percent) or 30% (thirty percent) is increased to 100% (one hundred percent) in the case of:

In the case of the physical inspection on bulk goods , on the basis of the professional judgement goods inspectors must:

(1) Based on request from importers, physical inspection of imported goods packed in refrigerated container can be executed:

(2) Heads of Customs Offices or the appointed officials examine to decide whether physical inspection can be executed in warehouses of importers or through hi-co scan x ray container.

Article 15

(1) Physical inspection is executed by one goods inspector for one Import Declaration.

(2) In the event that quantity and/or kind of goods has high difficulty rate so as to indicate that physical inspection would affect the smooth flow of goods, official of the Customs and Excise Section can stipulate that physical inspection is executed by more than one goods inspector for one Import Declaration.

(3) The addition to the number of goods inspector as intended in paragraph (1) can be proposed by the goods inspector or on the basis of initiative of officials of the Customs and Excise Section.

Article 16

(1) In the case of certain technical knowledge being needed in physical inspection, goods inspectors can recommend assistance from other parties to officials of the Customs and Excise Section.

(2) The other parties as intended in paragraph (1) are internal or external parties of the Directorate General, having the required technical knowledge.

(3) In the case of the provison in the import field requiring physical inspection by officials of other institutions, the physical inspection can be executed jointly.

(4) Information about the physical inspection as intended in paragraphs (1) and (2) is recorded in Physical Inspection Protocol and Inspection Report (LHP).

Article 17

(1) In the framework of physical inspection, importers or their proxies are obliged to:

Article 18

(1) Goods inspector submits samples of goods, photos of goods and/or documents of specificatyon of products accompanying the goods for stipulating classification and/or customs value in accordance with inspection instruction or on the basis of his/her initiative.

(2) Procedures for taking samples of goods are as stipulated in Attachment II to this regulation.

Article 19

Procedures for physical inspection are as stipulated in Attachment I to this regulation.

Article 20

(1) Goods inspectors would construct protocol of physical inspection of imported goods as stipulated in Attachment III to this Regulation.

(2) Importers/proxies or organizers of provisional collection places/customs collection places/bonded collection places to sign the protocol of physical inspection of imported goods as intended in paragraph (1).

Article 21

(1) Goods inspectors mention result of the physical inspection in Physical Inspection Report (LHP).

(2) Procedures for including result of the physical inspection are as stipulated in Attachment IV to this regulation.

Article 22

(1) Goods inspectors are responsible for the quantity and kinds of goods inspected physically and irresponsible for goods, which are not inspected physically.

(2) Goods inspectors put sign in the form of initial in the inspected packages.

Article 23

The regulation comes into force as from April 9, 2007.
